These General Terms and Conditions apply to the supply and sale of goods and services. They are deemed to be known and accepted by the customer at the time of placing an order. Any deviations from these terms must be explicitly agreed upon in a separate written agreement. These terms always take precedence over those of the customer, even if the latter states that their terms are exclusively applicable.
The potential nullity of one or more provisions of these General Terms and Conditions shall not affect the validity or applicability of the remaining clauses.
1. Orders
Orders can be placed either online via the CRAFTAILS webshop or through a CRAFTAILS representative/ambassador.
The customer selects the delivery and billing address and chooses a delivery time slot from the available options on the website.
CRAFTAILS reserves the right to subject the confirmation of an order to additional conditions, suspend it, or refuse it in the following non-exhaustive cases:
Provision of clearly incorrect information
Incomplete order form
Non-payment of previous deliveries
Order of an unusually high quantity of products or total amount
Request to deliver in a geographic area that carries unreasonable risks due to uncertainty in transport or distribution.
2. Cancellation
An order accepted by CRAFTAILS may only be cancelled by the customer up to 24 hours before the chosen delivery time, and must be done in writing or electronically.
CRAFTAILS also reserves the right to cancel an order if it becomes apparent that it is based on incorrect information provided by the customer.
In the event of non-payment or late payment of the agreed advance or prepayment, CRAFTAILS may consider the order, in whole or in part, as cancelled.
Such cancellation will not give rise to any compensation to the customer.
3. Advance and Prepayment
CRAFTAILS reserves the right to request full or partial prepayment before proceeding with the delivery of an order.
Non-payment of the agreed advance will automatically result in suspension of the delivery timeline.
In the event of non-payment or late payment of the advance or prepayment, CRAFTAILS may consider the order, in whole or in part, as cancelled.
Unless otherwise agreed, a new customer placing an order for the first time with CRAFTAILS must pay in cash at the time of delivery at the latest.
4. Electronic Payment Security
In the case of electronic fund transfers, the security and proper execution of the payment instruction is the sole responsibility of the financial institution managing the transfer.
CRAFTAILS cannot be held liable for any damage resulting from an error, negligence or unlawful act not attributable to it.
5. Delivery
Unless otherwise agreed, CRAFTAILS is responsible for the shipment and delivery of the ordered goods.
The agreed delivery time, i.e., the time slot selected by the customer, is purely indicative. If delivery cannot take place within 3 days of the selected time slot, the customer may cancel the order free of charge and receive a refund of any amount already paid for that order.
Failure to meet or exceed the delivery time does not give rise to any compensation from CRAFTAILS.
The agreed delivery time will automatically lapse if CRAFTAILS does not receive all necessary information in time, in case of order changes by the customer, or in the event of force majeure.
6. Prices
Unless otherwise agreed, products/goods are invoiced at the rates listed in the standard price list previously communicated to the customer.
All prices are expressed in euros and exclusive of VAT and other applicable taxes.
7. Invoicing
Unless agreed otherwise in writing or in the event of changes in legislation, as of 01/01/2026, all invoices in the context of a business-to-business (B2B) transaction will be sent electronically via Peppol in a structured format in accordance with applicable law.
Customers are deemed to be aware of the electronic invoicing procedure.
8. Payment Terms
The invoice payment term is 14 calendar days from the invoice date.
In the event of late payment, interest will automatically be due from the due date of the invoice, without prior notice, at the statutory rate in accordance with Article 5 of the Law of 02/08/2002 on combating late payment in commercial transactions.
In addition to this interest, the creditor is entitled, in the event of non-payment, to a fixed compensation of €40 for collection costs, regardless of the principal amount. This fee becomes automatically payable once the payment term has expired and will be added to the outstanding balance.
Furthermore, in the event of non-payment, a fixed indemnity of 10% of the outstanding amount, with a minimum of €250, will be charged for all relevant collection costs arising from the delay.
If the customer fails to meet payment obligations, the supplier is entitled to immediately suspend further deliveries and to consider the agreement as legally dissolved, without notice.
Unless agreed otherwise, any new customer placing an order for the first time must pay in cash upon delivery; if not, the order will be considered cancelled as stipulated in Article 3.
9. Personal Data Protection
The customer’s personal data are processed for the execution of the agreement, customer administration, and its management, including online support and assistance, sales, commercial prospecting, and accounting.
Processing is necessary for the execution of the contract and based on the legitimate interest of conducting business.
Personal data will only be processed to the extent and for the duration necessary to provide the service or product. They will not be disclosed to third parties or used for purposes other than service execution.
The customer may at any time request access to their data, request correction or deletion, or object to their processing.
10. Competent Court
In case of disputes, only the courts of the judicial district where CRAFTAILS has its registered office are competent. Belgian law always applies.
11. Language
The original language of these General Terms and Conditions is Dutch. Translations or documents in other languages are provided solely as a courtesy to the customer. In case of discrepancies, the Dutch version shall prevail.
